1. Placing of Orders:

Orders shall be accepted in writing, by e-mail, telephone or fax, and shall only be binding once accepted by SPIRIT 2012, S.L. by confirmation of the order by any of the means of communication described above. The Customer must check the order confirmation and notify us immediately, in writing, of any errors. Otherwise, the product description in the order confirmation will become part of this Agreement and will be binding on the parties.

Orders shall be subject to availability and acceptance by SPIRIT 2012, S.L., which may reject the order at any time and at its sole discretion. Quotations, or economic offers, shall only be valid in writing, and for the period of time indicated therein. If no period is indicated, this will be 30 days.

To place an order through the Website, the Customer must select the Products, add them to the shopping cart and choose the method of payment. SPIRIT 2012, S.L. will not accept orders placed in any other way than those detailed above.

By placing an order, the Customer will have made an offer to purchase the Products he/she has selected. Orders are subject to availability and acceptance by SPIRIT 2012, S.L., which may reject the order at any time and at its sole discretion, including, by way of example, in the following cases:

-        When the Customer provides incorrect information including, without limitation, insufficient or incorrect payment information, incorrect billing information, incomplete or incorrect shipping address, or fraudulent information.

-        When there is an error on the SPIRIT 2012, S.L. website relating to the products that the Client has requested, such as, for example, an error relating to the price or description of the products with respect to the information shown on the website.

-        When the Products ordered by the Customer are no longer available through the Website.

-        When SPIRIT 2012, S.L. has reason to believe that the Client is not of legal age.

The Products are described in the catalogue or website of SPIRIT 2012, S.L. which may be modified by any applicable Specification.

SPIRIT 2012, S.L. shall not be liable to the Client or any third party for the removal of any product from the Website, the removal or editing of any material or content of the Website, the refusal to process an order or the suspension of a transaction once it has begun to be processed.

In the event of not being able to accept or process the order, SPIRIT 2012, S.L. will contact the Client, via email, as soon as possible and, in any case, within 30 days from the date of the order.

However, SPIRIT 2012, S.L. reserves the right to cancel the order, at any time, due to objective circumstances beyond its control.

If SPIRIT 2012, S.L. cannot accept or process the order because the products are no longer available, or due to an error in the price and/or other data relating to the Products for which the order has been placed, the Customer will be notified and the order will be cancelled with respect to those products that SPIRIT 2012, S.L. cannot supply. As well as, to reimburse the Customer the amount paid for such Products.

When the Customer places an order through the SPIRIT 2012, S.L. website, he/she will receive an automatic e-mail confirming receipt of the order. This e-mail contains the relevant details of the order. The order will be accepted and the contract between SPIRIT 2012, S.L. and the Customer will only be concluded when the products are shipped. At that specific moment, the Customer will receive an e-mail "Order Dispatch Confirmation", informing him/her that SPIRIT 2012, S.L. has dispatched all or part of the Products indicated in the order.

SPIRIT 2012, S.L. will not accept any type of cancellation of orders other than those indicated above.

2.     Pricing:

The prices of the products are indicated on our website and will be confirmed in the automatic "Order Confirmation" e-mail that the Customer will receive after completing the order process. The prices are in euros and include VAT, except for those countries or areas that are exempt from VAT, as well as all applicable taxes. The prices do not include transport, any other type of expense, tax or fee. Shipping costs may be applied at the time your order is submitted and will depend on the value of the order and the shipping method chosen.

SPIRIT 2012, S.L. shall not be liable for special taxes, customs duties or additional delivery costs. SPIRIT 2012, S.L. reserves the right to change its sales prices at any time, except for orders that have already been placed.

3.     Payment and Reservation of Ownership:

SPIRIT 2012, S.L. will accept payments made by Bizum and PayPal, as well as by credit or debit cards, by means of electronic cash on delivery and bank transfer, depending on availability, depending on the country where the order is sent. No other form of payment will be accepted, with the exception of those mentioned above.

Payments must be made in the currency indicated on the order before shipment.

If the Customer pays by credit or debit card, he/she must provide his/her credit or debit card details when placing the order. Your credit or debit card will be charged for the total value of the order at the time the order is accepted. SPIRIT 2012, S.L. will not accept the order or supply the products to the Customer until the issuer of your credit or debit card has authorised the use of your card in respect of payment for the products ordered.

If SPIRIT 2012, S.L. does not receive such authorisation, the Client will be notified. SPIRIT 2012, S.L. reserves the right to verify the identity of the credit or debit card holder by requesting the appropriate documentation. All credit and debit card transactions are carried out through a secure online payment platform that will carry out the automated processing of information relating to your payment details in a secure environment. At any time, and at the sole discretion of SPIRIT 2012, S.L., shipments may be restricted to certain countries or regions that are considered to have a high risk of fraud.

In order to guarantee the security of payment transactions, SPIRIT 2012, S.L. uses a secured payment system. This means that all confidential data is encrypted and transmitted directly to a secure server, using Secure Socket Layer (SLL) technology.

SPIRIT 2012, S.L. reserves the right to interrupt, temporarily or permanently, the supply of orders if the Client has failed to comply with any of the payment commitments acquired. The place of delivery is indicated in the order confirmation. SPIRIT 2012, S.L. reserves its right of ownership of the product in the event of total or partial non-payment of the order. If the Customer refuses delivery without prior approval from SPIRIT 2012, S.L., any resulting costs or damage shall be borne by the Customer, including storage until acceptance.

Likewise, SPIRIT 2012, S.L. shall not be liable for delays in the delivery of the goods resulting from the lack of authorisation by the bank.

SPIRIT 2012, S.L. is responsible for keeping, insofar as it is empowered to do so, the order and payment details secure; however, in the absence of negligence on the part of SPIRIT 2012, S.L., it shall not be liable for any losses that the Client may suffer if a third party attempts to gain unauthorised access to the information provided by the Client when accessing the website or placing an order.

4.     Conditions of purchase:

The products shown on the website are only a selection from the SPIRIT 2012, S.L. catalogue. This collection has been specially selected for the SPIRIT 2012, S.L. online shop. The SPIRIT 2012, S.L. online shop accepts no responsibility for the lack of stock or any of the models shown. Our products change every season.

Please note that the items in the "shopping cart" of SPIRIT 2012, S.L. are not reserved and can be purchased by another customer.

SPIRIT 2012, S.L. uses the following purchasing procedure:

-       You must "select" and "Add to Cart" the item(s) you wish to purchase by clicking on the "Add to Cart" icon on the website.

-       "Add to Cart" will include the reference number of the item(s) selected, the name, size and price (including VAT).

-       In the ''Cart'', we will show you a list of the item(s) you are about to buy, the total price (including VAT and shipping costs).

-       Once you have selected the item(s), you must fill in the order form. On this order form you must indicate your personal details and payment information in order to process your order. Please note that all details must be filled in correctly to avoid confusion and problems when sending the purchased item(s).

5.     Confirmation of the order:

Once you have made your choice and placed your order, you will receive an email from SPIRIT 2012, S.L. confirming that your order has been registered (order confirmation). This order confirmation will include, among other things, information regarding the identification of the item(s) purchased, the total price (including VAT and shipping costs) and delivery details.

If you make a mistake when placing your order, please contact our "Customer Service", where we will be happy to assist you. However, always make sure you check your order before placing it. Before confirming your order, you have the possibility to edit the information you have entered, such as the delivery or billing address or your credit card details; you can also change or delete items in your "Cart".

If an error occurs in the message, it may be a temporary communication problem with the network or an error in typing the email address provided. In both cases, please contact our "Customer Service" at SPIRIT 2012, S.L. reserves the right not to accept your order if, for example, it is not possible to obtain payment authorisation, if shipping restrictions apply to a particular item or if the item is not in stock. In the latter case, we will inform you by email and refund all payments that have been made.

6.     Places and delivery times:

Deliveries of the products purchased can only be sent to Spain and to a list of countries that will appear to the Customer while placing the order. All products will be shipped from SPIRIT 2012, S.L. warehouses in Spain and returns must be made to the same place.

Deliveries are made during normal working hours, Monday to Friday (excluding public holidays). No deliveries are made on Saturdays, Sundays or on public holidays in the particular region or country.

SPIRIT 2012, S.L. does not guarantee delivery times due to the fact that shipments are managed by third parties. Therefore, the delivery times of orders are established as mere guidance and do not contemplate possible delays arising from the payment authorisation process. SPIRIT 2012, S.L. will not be able to modify the delivery address once the order has already been placed.

Multiple orders will be shipped when all items are available. Partial shipments are not available.

SPIRIT 2012, S.L. reserves the right to withhold any order for security reasons. Affected customers will be notified. It also reserves the right to cancel the order when it is unable to verify the shipping and/or billing details, in which case the Customer will be notified. Likewise, SPIRIT 2012, S.L. reserves the right not to accept and/or cancel an order if it considers that the buyer wishes to obtain the items for resale.

Customers wishing to purchase more than 5 pairs of shoes should contact the "Customer Service Department" of the SPIRIT 2012, S.L. online shop, where they will be given detailed information about the purchase options.

Deliveries shall be made to the usual place of residence or place of work located in one of the countries activated for the sale. All deliveries must be signed for upon receipt. Once the receipt has been signed for, the goods become the responsibility of the consumer. SPIRIT 2012, S.L. does not deliver to post office boxes.

In order to avoid problems with deliveries (incorrect addresses, person absent at the address), the corresponding form must be filled in correctly, especially the box with the contact telephone number.

When your order has left the warehouse, we will send you an email with the tracking number of the package assigned by the courier company for the delivery of your item(s). You will then be able to see where your order is at all times. If you have ordered more than one pair of shoes, we will wait until all items in the order are available before shipping, as we do not make partial deliveries.

SPIRIT 2012, S.L. reserves the right of ownership of the product in the event of total or partial non-payment of the order, until payment is received.

7.     Transport:

Delivery will be made by standard or express courier service, according to the Customer's choice, during normal working hours. Delivery charges will be applied to the Customer's order. All purchases of SPIRIT 2012, S.L. items are delivered by courier companies of recognised prestige.

All products will be delivered to the delivery address indicated in the "Order Confirmation" made by the Customer.

Any delivery time specified by SPIRIT 2012, S.L. is merely an indicative estimate. SPIRIT 2012, S.L. shall assume no liability for any loss or damage that the Customer may incur in the event of an unavoidable delay in delivery. Title and risk of loss relating to the products shall pass to the Customer at the time of delivery.

In the event that no one responds at the delivery address provided who can accept delivery of the goods, the carrier will leave a notice in your mailbox.

SPIRIT 2012, S.L. shall not be liable for any costs incurred as a result of failure to meet the delivery date. Both the ownership and the risk of damage and/or loss of the products shall pass to the Client when SPIRIT 2012, S.L. has made the products available to the carrier or to the Client.

8.     Product modifications and cancellations:

SPIRIT 2012, S.L. reserves the right to modify its products in order to improve their quality, aesthetics or design, as long as the fundamental characteristics of the product are not modified. SPIRIT 2012, S.L. reserves the right to cancel any product in the catalogue without prior notice.

9.     Claims and product cancellations:

The buyer shall indicate their disagreement, if any, on the goods, within 30 calendar days of receipt of the product, by written communication addressed to SPIRIT 2012, S.L., specifying the reasons and/or nature of the same for the return or exchange of the article.

You may cancel your order(s) at any time prior to dispatch and you will receive a full refund. If your order has already been dispatched (has already left the warehouse) you will have to wait until delivery before you can cancel your order, although such cancellation will be subject to the terms and conditions set out for returns.

To cancel an order before it is shipped, go to MY ACCOUNT in the "Order history and details" section, click on the order reference and send us a message from the bottom window "Add a message" CANCELLING the order. You can also return your order once you have received it, in accordance with the conditions for returns.

You can also contact our "Customer Service" to cancel your order, as long as it has not been shipped.

Once the case has been studied, if the return request is accepted, an email will be sent with instructions on how to return the goods to the offices of SPIRIT 2012, S.L., at the following address:

These instructions will provide information about the order and the return number for tracking by both parties.

Model changes or returns are not permitted without objective reasons. Although SPIRIT 2012, S.L. reserves the right to accept returns if it deems it appropriate, at the Customer's expense, who must pay the costs incurred by the change before the change is made.

The right of withdrawal is subject to the following conditions:

The customer should contact to obtain their Return Number and inform them of the items they wish to return.

Products must be returned in the same condition as received. They must not be damaged or used. Products must be returned in their original packaging, if the original packaging is not available, it must be replaced by one of similar size and capacity. Products from the same order must be returned in the same shipment; under no circumstances will returns of the same order be accepted separately.

Loss or deterioration of the goods, occurring after the passing of risk to the buyer, shall not release the buyer from his obligation to pay the agreed price.

When the transport is not at the expense of SPIRIT 2012, S.L. or the transport agency has been chosen by the Client, SPIRIT 2012, S.L. shall not be liable for any damage caused during transport. The fact of having a dispute due to breakage or transport reasons does not give the right to withhold all or part of the payment of the invoice.

SPIRIT 2012, S.L. shall not be liable for any dispute or litigation between the customer and the end user and/or purchaser or owner.

As long as the products are in the Customer's possession, the Customer shall be obliged to ensure that they are kept safely and in good condition.

10.  Returns and Exchanges:

If, after receiving the order, the Customer is not satisfied, he/she has a period of 30 calendar days from receipt of the order to return or exchange the item. To return or exchange an order, the following conditions must be met:

-       The product must not be used.

-       The product must be returned in the same condition in which it was sent and where possible in its original packaging. If the original packaging is not available, it should be replaced by one of similar size and capacity.

-       The product must be returned, within 30 calendar days of receipt of the order, to our offices at the following address:

If the exchange or return is requested in order to obtain a product of a different size, colour, model, or is due to a manufacturing defect, there will be no cost to the Customer.

However, returns and exchanges in the Canary Islands, Ceuta, Melilla, Europe (except Portugal) and the rest of the world will be at the Customer's expense, who must return the goods by their own means and, if it is an exchange, place the order again (only one exchange per order).

In the event that the exchange or return is requested for reasons other than the above (such as, for example, that the product does not meet the expected expectations, or the customer has found another product that he/she likes better), the return shipping costs will be charged to the Customer, who will have two options:

1º - Shipment by the method of transport chosen by the Client, who will assume the transport costs of the chosen company. If it is a return, in the event that the customer chooses this method of shipment, and provided that all the conditions established are met, the full price of the returned product will be refunded.

2º - You may choose to make the return with the company SPIRIT 2012, S.L. who will send a courier to pick up the order. In this case, the following amounts will be deducted from the price of the product being returned:

4'80€ Spain Mainland. 9'90€ Spain Balearic Islands. 7€ Portugal.

The shipping costs include the costs for the preparation (handling and administration) of the order as well as the transport costs.

SPIRIT 2012, S.L. does not allow exchanges in multi-brand shops that sell its products. SPIRIT 2012, S.L. also does not allow the return of items to the online shop when they have been purchased in multi-brand shops that sell their shoes.

11.  Returns:

To request the return of an item, the following steps must be followed: In the customer account, access the "Order history and details" section and select the order reference. Once the order reference has been selected, select the lower window "Add a message" indicating the model or models that you wish to return, also indicating the reason for the RETURN.

You can also contact our "Customer Service" to cancel or return an order by calling 672 153 095.

Once we have received the item/s, and after verifying that it/they comply with the aforementioned conditions, SPIRIT 2012, S.L. will proceed to reimburse the amount paid for the item/s.

SPIRIT 2012, S.L. is entitled to deduct the initial delivery costs. The direct costs of returning the item(s) shall always be borne by the customer, except in the event that the return is due to a manufacturing or quality defect, where SPIRIT 2012, S.L. shall be responsible for the costs of returning the item(s).

If the item is returned as a result of a manufacturing or quality defect for which SPIRIT 2012, S.L. is responsible, the full amount will be refunded within 30 working days. The credit will be made automatically to the credit card or bank account indicated by the Customer, depending on the method of payment used by the latter.

In any case, carriage forward shipments will not be accepted.

12.  Changes:

To request a size or model change, please follow the steps below: Follow the same process as for returns from MY ACCOUNT. The system will display the details of the order. Once you have selected the order reference, select the lower window "Add a message" indicating the model or models you wish to change, and indicating the new model, colour and size, and we will contact you to proceed with the change.

When we have received the item(s), the new size or model(s) will be shipped, using the same service that was used for the original purchase.

Exchanges and returns of products purchased through our online shop must be returned to the following address:

13. Online dispute resolution:


In the event that you, as a Consumer, consider that the "Customer Service" of SPIRIT, S.L. has not acted with due diligence, following the terms stipulated in these General Conditions of Sale and Guarantee, and that it is not offering you a satisfactory solution in this respect, you may file the corresponding complaint online via the following link:, as online/e-commerce shops are not obliged to have a Complaints Form.

14. Guarantee of the product purchased on the Web:

In the event that the Client is a consumer, the commercial guarantee will be regulated by Royal Decree 1/2007, of 16 November, which approves the revised text of the Law for the Defence of Consumers and Users and other complementary legislation, taking into account the amendments made to this regulation by Royal Decree-Law 7/2021, of 27 April, transposing European Union directives on consumer protection, in particular Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the sale of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC, and repealing Directive 1999/44/EC.

Taking into account the regulations applicable to all products supplied within the Spanish territory, in cases of lack of conformity with the products, SPIRIT 2012, S.L. shall be liable for any lack of conformity that exists at the time of delivery or supply and which becomes apparent within three years of delivery, the date of delivery being considered to be that which appears on the commercial invoice. Possession of the commercial invoice by the consumer shall be a prerequisite for making use of the commercial guarantee.

On the other hand, outside the national territory, as stipulated by the European Union in Directive 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the sale of goods, amending Regulation (EC) No. 2017/2394 and Directive 2009/22/EC and repealing Directive 1999/44/EC, SPIRIT 2012, S.L.  shall be liable to the consumer for any lack of conformity that exists.No 2017/2394 and Directive 2009/22/EC and repealing Directive 1999/44/EC, SPIRIT 2012, S.L. shall be liable to the consumer for any lack of conformity that exists at the time of delivery of the goods and becomes apparent within two years from that time.

End users may only claim the above warranty rights in relation to products purchased and invoiced to them directly through the SPIRIT 2012, S.L. website. In the case of products purchased through an external distributor, end users must send any warranty claims directly to the seller to request their product warranty conditions.

This warranty only covers non-conformities that existed at the time of delivery of the product. However, it shall not be valid for external damage caused to the Product by any cause, wear and tear, or due to fraud or negligence on the part of the Buyer, as well as in the case of incidents caused by force majeure. In short, the commercial guarantee shall not cover any damage caused by any reason beyond the responsibility of SPIRIT 2012, S.L.

The verification of the product will only be carried out by our staff and in our own facilities. Taking into account the nature of the product, in the event that the existence of a lack of conformity covered by the commercial guarantee is verified, SPIRIT 2012, S.L. will carry out, as far as possible, the corrective measure for the lack of conformity that avoids disproportionate costs for the company. In the event of repairing the products in which there is a lack of conformity, only the actions that are strictly necessary for the repair of the accredited lack of conformity will be free of charge.

Excluded from this warranty are all damages caused to the product during transport, as well as those resulting from subsequent inadequate storage and protection. Likewise, this guarantee will be immediately void in the event that the product is manipulated, modified or repaired by any person without the authorisation of SPIRIT 2012, S.L.

Product returns, without just cause under the terms of this guarantee, will only be accepted when previously authorised in writing by SPIRIT 2012, S.L., provided that they are made in accordance with the provisions of clauses 10 and 11 of these Conditions.

None of the terms and conditions granted in this warranty can be extended or modified in any way without the express consent of SPIRIT 2012, S.L.

In the event that the legislation for the protection of Consumers and Users establishes presumptions in relation to the existence of lack of conformity at the time of delivery of the products to the end consumer, it will be assessed whether the presumption is compatible with the nature of the product and the nature of the lack of conformity that is revealed, likewise, in the case of presumptions that affect the lack of conformity, SPIRIT 2012, S.L. will have the right to carry out an expert test to prove whether the lack of conformity existed at the time of delivery of the products.

15.  Dispute resolution and determination of applicable law:

Unless otherwise provided for in the applicable Consumer and User protection regulations, in the event of any dispute concerning the validity, performance or interpretation of this Contract, the parties undertake to resolve it amicably. However, if the parties do not reach an agreement through negotiation, they expressly agree that any litigation, discrepancy, question or claim resulting from the execution or interpretation of these General Conditions of Sale and Guarantee or related to these, directly or indirectly, will be definitively resolved through arbitration, within the framework of the Basque Court of Arbitration, with headquarters at Pº. Portuetxe nº 61 - 3º 20018 Donostia - San Sebastián (Spain), which is entrusted with the administration of the arbitration and the appointment of the arbitrators, in accordance with its Regulations and Statutes, which will resolve by applying Spanish law.

16.  Intellectual property rights:

All intellectual property rights (including copyright, patents, trademarks, trade names, database rights and design rights) and all information and material (including all logos, graphics and software) provided through this website are owned by SPIRIT 2012, S.L. or its affiliates, or used with the consent of the relevant rights holders, and are explicitly reserved.

Use of this website and its contents does not in any way grant any right or license with respect to the copyright, designs, trademarks and any other intellectual property rights relating to the Content (as described in the Content section below), including the SPIRIT 2012, S.L. software and all HTML and other code contained on this website. Such Content, including third party trademarks, designs and intellectual property rights mentioned or displayed on this website, are protected by national intellectual property and other laws and international treaty provisions.

-        Do not sell SPIRIT 2012, S.L. products through third-party online shops (e.g. Spartoo, Privalia, AmazonBuyvip, Asos, Sarenza, etc.).

All information exchanged is the exclusive property of the party from which it originates. Consequently, neither party will use the information of the other for its own use. The trademarks, logos, signs and other distinctive signs identifying the products manufactured or marketed by SPIRIT 2012, S.L., shall be registered in accordance with the legal provisions on intellectual property and the laws and regulations in force. The client undertakes to ensure the protection of the brand, logo, sign and distinctive signs and to implement the necessary actions for effective protection. The customer acknowledges that the use granted to him under this agreement of the trademark, sign and other distinctive signs does not confer on him any ownership rights therein. The customer undertakes to use peacefully the trademarks, logos, signs and rights of SPIRIT 2012, S.L., and may use all brand names in all advertising or other activities carried out by SPIRIT 2012, S.L. in connection with the promotion and sale of the Products. The customer agrees not to register or apply for registration of any SPIRIT 2012, S.L. trademarks, logos and signs (or other similar signs that are confusingly similar to those of SPIRIT 2012, S.L.). The client shall notify SPIRIT 2012, S.L. of any violation of the trademarks, logos and signs registered by SPIRIT 2012, S.L., as well as the industrial property rights owned by SPIRIT 2012, S.L., that come to its knowledge.

17.  Protection of Personal Data:

SPIRIT 2012, S.L. in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR); of the Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD); and of the Law 34/2002, of 11 July, on information society services and electronic commerce (LSSICE), informs you that your personal data will be included in files owned by SPIRIT 2012, S.L., whose purpose is the management of suppliers, clients, performance of contracted services, commercial monitoring of clients and other commercial communication actions.

SPIRIT 2012, S.L. will not transfer your personal data to third parties, unless required by law or as a result of the legal relationship. Likewise, SPIRIT 2012, S.L. informs you that it does not plan to transfer them to a third country or international organisation.

However, you may, at any time, exercise your right of access, rectification, deletion, limitation of processing, opposition or, where appropriate, data portability, in the manner provided by law; that is, by sending a communication to SPIRIT 2012, S.L., at the address, attaching a copy of your DNI/NIE/PASSPORT.

The data will be retained for as long as the collaboration is maintained, unless you exercise your rights of control, and thereafter for as long as necessary for the fulfilment of any legal obligation or for the fulfilment of any obligation arising from the pre-existing legal relationship.
